1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of CabVirat’s applications, services, websites, and software (collectively, the “Services”). Please read these Terms carefully before using our Services.

By creating an account or using any of our Services, you agree to be bound by these Terms, our Privacy Policy and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing the Services.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years of age
  • Have a valid phone number, email address, and payment method
  • Complete our registration process and create an account
  • Possess a valid government-issued ID if registering as a driver

3. User Accounts

When you register for an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account details and password.

You are solely responsible for all activities that occur under your account. You must immediately notify CabVirat of any unauthorized use of your account or any other breach of security.

CabVirat reserves the right to suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms.

4. Service Usage

As a rider, you agree to:

  • Provide accurate pickup and drop-off locations
  • Be present at the pickup location when the driver arrives
  • Treat drivers and their vehicles with respect
  • Not engage in any illegal, threatening, or disruptive behavior
  • Pay all applicable fares, fees, and taxes

As a driver, you agree to:

  • Maintain a valid driver’s license and all required permits and licenses
  • Maintain appropriate insurance coverage
  • Keep your vehicle clean, safe, and in good operating condition
  • Comply with all applicable laws and regulations
  • Follow traffic rules and drive safely
  • Treat riders with respect and professionalism

You may not:

  • Use the Services for any illegal purpose
  • Impersonate any person or entity
  • Harass, abuse, or harm another person
  • Interfere with or disrupt the Services
  • Attempt to gain unauthorized access to the Services
  • Use the Services in any manner that could damage, disable, overburden, or impair the Services

5. Payments and Fees

All fares are calculated based on distance, time, demand, and other factors. Fares may include taxes, fees, tolls, and surcharges.

You agree to maintain a valid payment method on file with CabVirat. By providing a payment method, you authorize CabVirat to charge the applicable fees to that payment method.

Cancellation fees may apply if you cancel a ride request after a driver has been assigned or if the driver waits at the pickup location for more than the specified time.

CabVirat may offer promotions, referral programs, or discounts at its discretion. These offers may be subject to additional terms and conditions.

6. Ratings and Feedback

Both riders and drivers can rate each other after a completed trip. These ratings help maintain quality standards within the CabVirat community.

All feedback must be honest, respectful, and not contain any offensive, defamatory, or inappropriate content.

7. Intellectual Property

All content, features, and functionality of the Services, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of CabVirat or its licensors.

Subject to these Terms, CabVirat grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial purposes.

You may not:

  • Copy, modify, or create derivative works of the Services
  • Reverse engineer, decompile, or disassemble any aspect of the Services
  • Remove any copyright, trademark, or other proprietary notices
  • Use the Services for any commercial purpose without CabVirat’s prior written consent

8. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you consent to our collection and use of information as described in our Privacy Policy.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CABVIRAT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

CABVIRAT’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO CABVIRAT FOR USE OF THE SERVICES DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

10. Indemnification

You agree to indemnify, defend, and hold harmless CabVirat and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another.

11. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the rules of [Arbitration Association]. The arbitration shall be conducted in [City, State/Country].

YOU AND CABVIRAT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

12. Changes to Terms

CabVirat reserves the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website or through other reasonable means. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

13. Termination

CabVirat may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

14. General Provisions

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CabVirat regarding the Services and supersede all prior agreements and understandings.

The failure of CabVirat to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

You may not assign these Terms without CabVirat’s prior written approval. CabVirat may assign these Terms without your consent to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of its assets.

15. Account Deletion

You may request to delete your account by sending an email to cab@cabvirat.com. Account deletion will be processed once all open transactions are completed. While transactional information may be retained for legal and business purposes, all personal information will be masked in accordance with our Privacy Policy and applicable laws.
